USCIS - Resubmission After Erroneous Rejection for Improper Fees

The below IS NOT from USCIS. It is from AILA, giving guidance to lawyers on how to handle the situation if a petition or application is rejected erroneously by USCIS for improper fees.

Did you file a petition or application prior to July 30?
Was it postmarked prior to July 30?
Have you received a rejection notice with instructions to refile with the new increased filing fees even though it was postmarked prior to July 30?

The following is from an AILA (American Immigration Lawyers Association) document. Information for lawyers for Resubmission After Erroneous Rejection for Improper Fees.

If it appears to be an improvident rejection, resubmit the original application/petition to the Service Center with a brightly colored cover sheet along with proof of timely delivery/postmark stating:

ATTN: CRU SUPERVISOR - CASE IMPROPERLY REJECTED FOR FEES

Enclose a cover letter detailing what fees were enclosed and what date the case was postmarked and/or received.

The above shows you how lawyers are being instructed to handle this situation and there is no reason why those not using a lawyer cannot do the same. Obviously, you don't follow step 3
