The IR-1 and CR-1 are the same visa, an Immigrant Visa. It is the length of time married at entry to the US that determines your immigration status. If you have been married less than two years you will have conditions on your Permanent Resident Status and will be granted a two year green card. You must then apply to have this condition removed within 90 days of the two year anniversary of your entry to the US. If you have been married two years or more on entry you will be granted Permanent Resident status with a 10 year green card.

USCIS Fee Schedule


U.S. Citizenship and Immigration Services (USCIS) reminds its customers that the agency’s new fee schedule is effective on Monday, July 30, 2007. Applications or petitions postmarked or otherwise filed on or after that date must include the new fee.

Please also note that USCIS has revised many of the forms to coincide with the new Fee Schedule, with certain forms (including the
I-129F) stating prior editions not accepted.

NOTE:

ALWAYS check the form download page at uscis.gov for current fee and SPECIAL INSTRUCTION information

Applications submitted with the wrong fee will be rejected

Children under 14 that are filing with the I-485 of at least one parent, are given a discount. If not filing with at least one parent then the FULL fee applies.

There is no fee for I-129F petitions for K-3 status based on an immigrant petition (Form I-130) filed by the same U.S. citizen or wife.

An applicant for adjustment of status who applies before the fee rule becomes effective will continue to have to file separate applications with fees for employment and travel authorization. Those who file an adjustment of status application (Form I-485) after the new fee schedule is effective will not have to pay the additional fees for employment and travel authorization as these costs have been included in the new adjustment of status application fee.

Please make sure to note the New Direct Filing Addresses for Form I-129F

Payment: Fees for forms and biometric services may be paid by one check or money order, or separate check or money order. Unless otherwise instructed, make the check or money order payable to Department of Homeland Security. Do not use DHS or USDHS.
